Unprecedented compensation to AI171 Air India cash victims - might be the highest the world has seen for an air accident. It's in 3 parts as follows: 1. Montreal Convention - statutory liability + as yet undefined variable due to any negligence found in accident investigation 2. Tata Sons - ₹1 cr per victim 3. Tata Trusts - ₹1 cr per victim Total Tata Sons + Tata Trusts is a pool of ₹500 cr. I think half of that is being parked in this welfare trust to disburse over a longer term. Part 1 of the compensation - the Montreal Convention - already is being litigated through lawyers by some victim's families. Expect a lot of litigation around this component as the reasons for the crash are yet unclear. Though not mentioned here - I think deceased aircraft crew are being compensated similarly separately. By my calculations - every victim is almost getting ₹4cr as of now. Now this will make it awkward for any future domestic air accident - currently compensation for that is capped at a mere ₹20 Lakhs. Will the government revise this arbitrary cap? While what the Tata's are doing is noble - do other airline management's have similar cash capacity to double the compensation? Will this be used as a legal precedent? Insurance companies will be worried. This might lead to an overall hike in compensation, thus more expensive insurance and more expensive flight tickets.
